1. Scope
These General Terms and Conditions (hereinafter “GTC”) of GutRaum8 UG (limited liability) (hereinafter “Seller”) apply to all contracts concluded between a consumer or entrepreneur (hereinafter “Customer”) and the Seller regarding the goods and/or services presented by the Seller in its online shop. The inclusion of the Customer’s own terms and conditions is hereby rejected, unless otherwise agreed.
For the purposes of these Terms and Conditions, a consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their self-employed professional activity. A business entity, for the purposes of these Terms and Conditions, is any natural or legal person or a partnership with legal capacity that, when entering into a legal transaction, acts in the exercise of its independent professional or commercial activity.
2. Formation of the contract
The product descriptions contained in the seller's online shop do not constitute binding offers on the part of the seller, but serve as an invitation to the customer to submit a binding offer.
The customer can submit an offer via the online order form integrated into the seller's online shop. After placing the selected goods and/or services in the virtual shopping cart and completing the electronic ordering process, the customer submits a legally binding offer to purchase the goods and/or services contained in the shopping cart by clicking the button that finalizes the order. Alternatively, the customer can also submit the offer to the seller by telephone, email, or mail.
The seller can accept the customer's offer within five days.
– by sending the customer a written order confirmation or an order confirmation in text form (fax or email), whereby the receipt of the order confirmation by the customer is decisive, or
– by delivering the ordered goods to the customer, whereby the receipt of the goods by the customer is decisive in this respect, or
– by requesting payment from the customer after they have placed their order.
If several of the aforementioned alternatives exist, the contract is concluded at the point in time when one of the aforementioned alternatives first occurs. If the seller does not accept the customer's offer within the aforementioned period, this is considered a rejection of the offer, with the consequence that the customer is no longer bound by their declaration of intent.
The period for accepting the offer begins on the day after the offer is sent by the customer and ends at the end of the fifth day following the sending of the offer.
When an offer is submitted via the seller's online order form, the contract text is saved by the seller and sent to the customer in text form (e.g., email or letter) along with these terms and conditions after the order has been submitted. Additionally, the contract text is archived on the seller's website and can be accessed free of charge by the customer via their password-protected customer account using the corresponding login details, provided the customer created a customer account in the seller's online shop before submitting their order.
3. Retention of title
The delivered goods remain the property of the seller until all claims have been paid in full.
4. Right of withdrawal
Consumers generally have a right of withdrawal. Further information regarding the right of withdrawal can be found in the seller's cancellation policy.
In the event of cancellation, the customer shall bear the regular costs of returning the goods as detailed in the cancellation policy.
5. Prices and payment terms, shipping costs
Unless otherwise stated in the seller's offer, the prices quoted are final prices and include statutory VAT. Any additional delivery and shipping costs/shipping fees are listed separately in the respective product description. Shipping within Germany is free for orders over €150; for orders under €150, the shipping fee is €5.90. Shipping fees to Austria, the Netherlands, and Luxembourg are €15.90, and to Switzerland €29.90.
Payment can be made by advance bank transfer, instant bank transfer, credit card, PayPal, or cash on delivery. The seller reserves the right to exclude certain payment methods.
If the customer chooses prepayment as their payment method, the seller will provide the customer with the bank details in the order confirmation. The invoice amount must be transferred to the seller's account within 10 days.
6. Delivery conditions
Delivery times are those stated in the offer and begin upon receipt of payment. Orders and deliveries are generally only possible within Germany, Austria, Switzerland, and Luxembourg.
7. Warranty
The warranty is governed by statutory provisions. If the subject of the purchase agreement is used goods and the customer is not a consumer, the warranty is excluded. If the customer is a consumer, the warranty period for the purchase of used goods is one year.
Links to other websites
To the extent that the seller refers to or links to third-party websites in its online offering, the seller cannot assume any warranty or liability for the accuracy or completeness of the content or the data security of these websites. Since the seller has no control over third parties' compliance with data protection regulations, the customer should review the respective privacy policies separately.
Applicable law
All legal relations between the parties shall be governed by the laws of the Federal Republic of Germany, excluding the laws on the international sale of goods. For consumers, this choice of law applies only to the extent that it does not deprive them of the protection afforded by mandatory provisions of the law of the state in which they have their habitual residence.
